New Era for Inherited Properties: First Sale to Family Members

A significant change has been made in the sale of inherited properties. With the 12th Justice Package, the first sale of inherited properties will be made only to family members. This regulation aims to resolve the long-standing disputes over inheritance and the sale of properties below their value. From now on, inherited properties such as houses, lands, and fields will be sold at their full value, as determined by experts, in the first auction. In the new system, the first auction for the sale of inherited properties will be reserved for family members. The old system, which started auctions at 50% of the estimated value, has been changed to prevent financial losses. Additionally, only family members will be able to participate in the first open auction. According to Gayrimenkul Hukuku Derneği (GHD) President Avukat Ali Güvenç Kiraz and Avukat Elvan Kakıcı, the regulation guarantees that properties will remain within the family. Only legal heirs (spouses, children, parents, or siblings) will be able to participate in the first sale. If no sale is made in the first auction, the second auction will be open to all third parties. This way, both the property rights of the heirs and the full value of the properties will be protected.
