Court of Cassation Makes Important Decision Regarding Consumer Rights in Time-Share Contracts

The 3rd Civil Chamber of the Court of Cassation has made an important decision regarding the right of consumers to cancel time-share contracts.The Chamber overturned the decision of the lower court in a case filed under the Consumer Protection Law No. 6502.In the case in question, a consumer paid 15,000 lira on the same day for a time-share membership contract. The consumer exercised their right to cancel within the legal timeframe by notifying the defendant company via notarized letter.The plaintiff initiated execution proceedings, claiming that the payment was not refunded despite the cancellation notice.In its decision, the 3rd Civil Chamber of the Court of Cassation emphasized that consumers can exercise their right to cancel within 14 days without giving any reason and without paying any penalty under Law No. 6502.
