Surprising Decision from the Court of Cassation: Husband Found Guilty of Heavy Fault for Insulting Meals
The 2nd Chamber of the Court of Cassation made an exemplary decision in a divorce case. In the case, mutual insults were exchanged and the parties' behavior within the marriage union was evaluated. The parties' words to each other and their behavior during the marriage were taken into account in determining the fault rates. The couple, who were experiencing severe incompatibility, applied to the Family Court and filed a mutual divorce lawsuit. The court determined that the man had told his wife "Your meals are terrible, your meals are poisonous, you are ignorant, you don't understand, look at your type, you are a thief, you are shameless" and that he had not done the household grocery shopping despite not liking the meals. Based on these evaluations, the court found the man heavily guilty and the woman slightly guilty. The court ruled that the parties should be divorced, the custody of the child should be given to the father, a personal relationship should be established between the mother and the child, and the woman should be awarded 750 TL per month for alimony and 20,000 TL for material and 15,000 TL for moral compensation.
