Turkish Court of Cassation Makes Important Decision: This Procedure Can No Longer Be Performed

The Turkish Court of Cassation has made an important decision regarding law cases. According to this decision, a matter not included in the lawsuit petition cannot be partially corrected through a process called "ıslah". The High Court allows the use of this right, which can only be used once during the trial, only to change and expand claims and defenses. The Grand Assembly of the Court of Cassation has implemented this important regulation through a decision to unify the jurisprudence. According to the decision, the plaintiff is required to consider all their demands when preparing the lawsuit petition and clearly state which matters or issues require legal protection, leaving no room for doubt.
