Grandchild Loses Property for Not Visiting on Holidays

The Turkish Court of Cassation has made a landmark decision regarding the transfer of real estate under an "elderly care contract". The property of a grandchild who was given real estate by their grandfather in exchange for care, but allegedly did not fulfill their obligations, was revoked. The grandfather had transferred the property to his grandchild in exchange for care until his death. However, the grandchild was sued for allegedly not fulfilling their obligations under the contract. The grandfather claimed that his grandchild did not take care of him, did not cook for him, and did not visit him when he was sick. The Court of Cassation ruled that the contract should be terminated and the property should be transferred back to the grandfather.After the decision, it was emphasized that the obligations of the caregiver are not limited to meeting material needs. The decision stated that, unless otherwise agreed, the care debt includes providing shelter, food, clothing, medical treatment, and all kinds of spiritual help and support to the care recipient.
