Competition Board Imposes Heavy Fine on Company for Abusing Its Dominant Position in the Nasal Spray Market

The Competition Board has imposed an approximate fine of 24 million lira on Avixa Pharmaceutical Company for abusing its dominant position in the nasal spray market and restricting competition.
According to the statement made by the Competition Authority, the company's practices restricted consumers' access to more affordable medication.
Avixa Pharmaceutical Company applied different discount policies for two medicines with the same content and formula, resulting in the product with the higher discount not being sufficiently supplied to the market. This situation limited consumers' access to affordable medication and caused damage to public resources.
The Competition Board evaluated these practices as an abuse of the company's dominant position and imposed a fine of approximately 24 million lira as a result of the investigation.
It was stated that the investigation resulted in the acceptance of commitments to suspend and revoke the license of the relevant product and to remove it from the reimbursement scope of the Social Security Institution.
