Changes in Notaries' Working Hours: A Significant Decision from the Constitutional Court

The Constitutional Court (AYM) deemed the provision that regulates notaries' working hours on holidays and outside regular hours through regulations as unconstitutional and annulled it. The High Court emphasized that regulations concerning workers' right to rest should be made through laws. The decision will come into effect 9 months later. The provision added to Article 52 of the Notary Public Law foresaw the regulation of notaries' working hours on holidays and outside regular hours through regulations. In the justification of the annulment decision, the AYM reminded that workers have the right to rest according to Article 50 of the Constitution. The High Court stated that regulations regarding weekly rest and leave should be made through laws, and that regulating notaries' working hours on holidays through regulations would restrict the right to rest.
