Can Birthright Citizenship in the US Still Be Revoked?

The US Supreme Court has struck down Trump's executive order limiting birthright citizenship. This decision upholds the long-standing interpretation of the 14th Amendment, granting automatic citizenship to almost everyone born in the US. Chief Justice John Roberts stated in the majority opinion, 'Children born in the US are citizens at birth.' Following the decision, Trump called for a legislative solution through Congress. To most constitutional scholars, the most direct method is to amend the Constitution, requiring a two-thirds majority in both the House and Senate, and then approval from three-fourths of the 50 states.

The Supreme Court upheld birthright citizenship, which is bad for our country. But we can fix it through legislation in Congress. It doesn't need a long and difficult constitutional amendment. Congress should start today to end this birthright citizenship that is costly and unfair for our country.

Congress could re-interpret the phrase 'subject to the jurisdiction' to pass a law. However, most legal experts argue that Congress cannot invalidate constitutional guarantees through ordinary legislation, which could lead to a new constitutional case. Some conservative scholars argue that the 1898 Wong Kim Ark decision does not fully cover modern immigration categories.
